The Royal referral to the Higher Council of Ulema, to contribute to the reflection on the revision of the Family Code, is a call to take into account the virtues of Ijtihad and the noble purposes of Islam, said Fatiha Chtatou, member of the executive board of the National Association of Lawyers.

In a statement to MAP, Chtatou noted that HM King Mohammed VI’s approach falls within the framework of Article 41 of the Constitution, according to which the Council is the only institution empowered to issue officially approved Fatwas.

She recalled that the Royal referral draws its essence from the Sovereign’s prerogatives in his capacity as Commander of the Faithful and Chairman of the Higher Council of Ulema, noting that this initiative is in line with His Majesty the King’s speech on the occasion of Throne Day 2022.

His Majesty King Mohammed VI, may God assist Him, Chairman of the Higher Council of Ulema, has given His High Directives to the said Council, to examine certain questions contained in the proposals
of the Body in charge of revising the Family Code, with reference to the principles and precepts of the holy religion of Islam and its purposes, and to submit a Fatwa on their subject to the Sovereign’s High Appreciation.
