Family Code: Royal Referral Takes Account of Ijtihad Virtues Serving Family’s Best Interests (Academician)


The Royal referral to the Higher Council of Ulema of certain proposals of a religious nature, brought to the High Appreciation of His Majesty King Mohammed VI by the body in charge of revising the Family Code, reflects the Sovereign’s commitment to promoting collective reflection on issues related to this project, emphasized Abdelaziz Oulasri, Professor of Fikh at the Mohammed VI Institute of Koranic Readings and Studies.

This initiative of the Sovereign takes into account the virtues of constructive Ijtihad and moderation that characterize the prescriptions of the Sharia, in the service of the best interests of the Moroccan family, he added in a statement to MAP.

Oulasri recalled that the Royal referral draws its essence from the religious prerogatives of His Majesty the King, in his capacity as Commander of the Faithful, and as Chairman of the Higher Council of Ulema.

It is also in line with the Sovereign’s far-sighted policy and enlightened guidelines in relation to societal issues, foremost among which
is the family.

This researcher affirmed that the Kingdom’s Ulema are competent to pronounce on the aforementioned proposals, stressing the imperative of drawing inspiration from the virtues and spirit of Ijtihad, in harmony with the rules of Islamic Sharia and its noble aims.

He praised the role of Moroccan Ulema in issuing Fatwas in line with the values and aims of Islam and the preservation of family interests, all within the framework of the High Royal Directives contained in the Letter from His Majesty the King to the Head of Government.

On Friday, His Majesty King Mohammed VI, may God assist Him, Chairman of the Higher Council of Ulema, kindly gave His High Directives to the said Council, to examine certain questions contained in the proposals of the Body in charge of revising the Family Code, with reference to the principles and precepts of the holy religion of Islam and its tolerant purposes, and to submit a Fatwa on their subject to the Sovereign’s High Appreciation.
